Please read these Terms and Conditions carefully before placing an order. Nothing in these Terms affects the statutory rights available to consumers under applicable law.

1. GENERAL PROVISIONS
1.1. These Terms and Conditions of Sale (the “Terms”) govern the relationship between MB MONTEKARL GROUP (the “Seller”, “we”, “us” or “our”) and any person purchasing products through our online shop (the “Customer” or “you”).
1.2. By submitting an order, you confirm that you have read and agree to these Terms.
1.3. If you are acting as a consumer, these Terms do not limit any mandatory rights you may have under the laws applicable in your country of residence. Customers in the United Kingdom retain the mandatory protections available under UK consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, where applicable.
1.4. You must not submit an order if you do not agree to these Terms.
2. PAYMENT
2.1. The payment methods currently available will be displayed at checkout. Depending on availability, these may include online banking, Visa, Mastercard and payments processed through third-party payment service providers.
2.2. The price, applicable taxes, delivery charges and final transaction currency will be clearly displayed before you submit your order.
2.3. Payments are processed through secure third-party payment platforms. We do not normally receive or store your complete payment card details.
2.4. An order will not be dispatched until the required payment has been successfully received or authorised.
3. FORMATION OF THE CONTRACT
3.1. To place an order, you must select the products, provide the required delivery and contact information, select a payment method and press the relevant order confirmation or payment button.
3.2. Your order constitutes an offer to purchase the selected products. The contract between you and the Seller is formed when we send you an order confirmation or dispatch confirmation, depending on the wording shown during checkout.
3.3. Each contract concluded through the online shop is recorded in our systems for the period required for order administration, accounting, dispute resolution and compliance with legal obligations.
3.4. We may refuse or cancel an order before dispatch if the product is unavailable, the payment cannot be authorised, the price or product information contains an obvious error, we reasonably suspect fraud, or we are legally prohibited from fulfilling the order. If payment has already been taken, it will be refunded.
4. CUSTOMER RIGHTS AND RESPONSIBILITIES
4.1. You have the right to purchase products in accordance with these Terms and applicable law.
4.2. You must provide complete and accurate billing, contact and delivery information and update it promptly if it changes before dispatch.
4.3. You must pay the product price, any delivery charge and any other charge clearly disclosed before the order is submitted.
4.4. You are responsible for reviewing the order details before completing your purchase.
4.5. If you believe that your consumer rights have been breached, please contact us at montekarlgroup@gmail.com and describe the issue, the relevant order and the remedy you are seeking. We will review the complaint and provide a reasoned response within a reasonable period and in accordance with applicable law.
4.6. If a complaint cannot be resolved directly, you may seek assistance from a competent consumer protection body, an applicable alternative dispute resolution provider or a court with jurisdiction. Lithuanian consumers may contact the State Consumer Rights Protection Authority at www.vvtat.lt. UK consumers may obtain independent guidance through the official consumer advice services available in their part of the United Kingdom.
4.7. The former European Commission Online Dispute Resolution platform is no longer available and is therefore not referenced as a complaint submission channel in these Terms.
5. SELLER RIGHTS AND RESPONSIBILITIES
5.1. We may restrict or suspend access to the online shop where a user attempts to damage, disrupt or misuse the Website, acts fraudulently or materially breaches these Terms.
5.2. We may temporarily suspend the online shop for maintenance, security, technical or operational reasons. This does not affect any orders or statutory rights that arose before the suspension.
5.3. We may amend these Terms by publishing an updated version on the Website. Any amendments will apply only to orders placed after the updated Terms take effect, unless applicable law requires otherwise.
5.4. We must provide products that comply with the contract and with all mandatory consumer protection requirements that apply to the sale.
6. DELIVERY
6.1. Products are delivered by third-party carriers to the address supplied in the order. Delivery charges, where applicable, will be displayed at checkout.
6.2. Unless a different estimate is shown on the product page or at checkout, the usual estimated delivery period is 10–18 working days after payment is received. Delivery dates are estimates unless we expressly agree a guaranteed date.
6.3. Delivery may take longer because of stock availability, customs procedures, carrier delays, public holidays, severe weather or other circumstances outside our reasonable control. We will provide updated information where reasonably possible.
6.4. You are responsible for checking delivery updates sent to the email address supplied with your order.
6.5. When a parcel is delivered, you or the person accepting it should check the packaging for visible damage. If possible, note any visible damage on the carrier’s delivery record and take photographs before opening the parcel.
6.6. If the products are damaged in transit, missing or do not match your order, please notify us as soon as reasonably possible. Our additional delivery guarantee allows priority reporting within 48 hours of receipt. When contacting us, please include the order number and clear photographs of the parcel, shipping label, product and damage.
6.7. The 48-hour reporting request helps us investigate the delivery quickly. It does not remove or reduce any statutory rights you may have regarding damaged, faulty, missing or incorrectly supplied goods.
6.8. Delivery is considered complete when the parcel is delivered to the address provided in the order and accepted by you or another person at that address, unless applicable law provides otherwise.
6.9. If another person will accept the parcel, you are responsible for ensuring that the delivery details are accurate and that the person is authorised to accept it.
6.10. Any applicable customs duties, import taxes or handling charges will be dealt with as stated at checkout or in the delivery information made available before purchase.
7. CANCELLATION AND RETURNS FOR ONLINE PURCHASES
7.1. Subject to the exclusions below, a UK consumer purchasing online normally has the right to cancel the contract without giving a reason within 14 days after the day on which the goods are received.
7.2. To exercise the right to cancel, you must send a clear statement to montekarlgroup@gmail.com before the cancellation period expires. Please include your name, order number and the products you wish to return.
7.3. After notifying us of the cancellation, you must return the products without undue delay and no later than 14 days after the date on which you notified us.
7.4. Unless the product is faulty, damaged, misdescribed or incorrectly supplied, you are responsible for the direct cost of returning it. We recommend using a tracked service and keeping proof of postage.
7.5. You must take reasonable care of the products while they are in your possession. We may reduce the refund to reflect any loss in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the product, where permitted by law.
7.6. Returned products must be securely packaged and include all supplied components and accessories.
7.7. We will make any refund due without undue delay and no later than 14 days after receiving the returned products or, if earlier, after receiving evidence that they have been sent back. We may withhold the refund until we receive the goods or evidence of return, where permitted by law.
7.8. Refunds will be made using the original payment method unless expressly agreed otherwise. We will refund the standard outbound delivery charge where required by law, but not any additional cost resulting from your choice of an enhanced delivery method.
7.9. The right to cancel does not apply in certain circumstances prescribed by law. In particular, it may not apply to sealed goods that are unsuitable for return for health protection or hygiene reasons once the seal has been broken. This may include oral-use products and mouthpieces after their hygienic seal has been opened. This exclusion does not affect your rights if the product is faulty, damaged, misdescribed or incorrectly supplied.
7.10. Other statutory exclusions may apply to personalised goods, rapidly perishable goods, sealed software or recordings once unsealed, newspapers and periodicals, and other categories specified by applicable law.
8. FAULTY, DAMAGED OR MISDESCRIBED PRODUCTS
8.1. Products supplied to UK consumers must be of satisfactory quality, fit for their usual or agreed purpose and as described.
8.2. If a product is faulty, damaged, misdescribed or otherwise does not conform to the contract, please contact montekarlgroup@gmail.com as soon as reasonably possible. Include your order number and, where helpful, photographs or a video showing the issue.
8.3. Depending on the circumstances and applicable law, you may be entitled to reject the product and receive a refund, or request a repair, replacement or price reduction.
8.4. UK consumers may have a short-term right to reject non-conforming goods within 30 days. After that period, the appropriate remedy will normally be a repair or replacement before a final right to reject or obtain a price reduction arises, subject to the Consumer Rights Act 2015.
8.5. If we require the product to be returned for inspection, we will provide reasonable instructions. We will bear reasonable return costs where the product is confirmed to be faulty, damaged, misdescribed or incorrectly supplied and the law requires us to do so.
8.6. We are not responsible for defects caused by accidental damage, misuse, failure to follow the instructions, unauthorised modification, improper storage or normal wear and tear. This does not affect liability for defects that existed when the product was supplied.
9. ADDITIONAL COMMERCIAL GUARANTEE FOR TECHNICAL PRODUCTS
9.1. Certain technical products and electrical appliances may include an additional 24-month commercial guarantee where this is stated on the product page or in the documents supplied with the product.
9.2. The commercial guarantee begins on the date the product is received. It is provided in addition to, and does not replace or restrict, your statutory consumer rights.
9.3. To make a guarantee claim, please provide reasonable proof of purchase and information showing the defect. An invoice, order confirmation or other reliable evidence of purchase may be accepted.
9.4. The commercial guarantee does not cover accidental or physical damage, normal wear and tear, or defects caused by improper, careless or unauthorised use.
9.5. We may request photographs, video evidence or return of the product for inspection. If the claim is accepted, we may provide a repair or replacement. If neither remedy is available within a reasonable time and without significant inconvenience, an appropriate refund may be provided in accordance with the guarantee and applicable law.
10. LIABILITY
10.1. You are responsible for ensuring that the information supplied during checkout is accurate. We are not responsible for losses caused by inaccurate information provided by you where we have acted reasonably on that information.
10.2. Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or liability arising under mandatory consumer law.
10.3. We are not responsible for content on third-party websites merely because the Website contains a link to them.
10.4. Product colours may appear slightly different depending on the screen, device settings and lighting. This does not permit material differences between the product and its description.
10.5. We are not liable for a failure or delay caused by events outside our reasonable control, but we will take reasonable steps to minimise the effect and will respect any cancellation or refund rights that arise under applicable law.
10.6. If you are a consumer, we are responsible for foreseeable loss and damage caused by our breach of these Terms or failure to use reasonable care and skill. We are not responsible for business losses arising from a consumer purchase.
11. PERSONAL DATA
11.1. We process personal data in accordance with our Privacy Policy and applicable data protection legislation, including the EU GDPR and, where applicable, the UK GDPR and Data Protection Act 2018.
11.2. Personal data required to process and fulfil an order is generally processed because it is necessary to enter into or perform the contract, comply with legal obligations, prevent fraud, administer customer service and protect legitimate business interests. Separate consent is not required where another valid lawful basis applies.
11.3. Necessary personal data may be shared with payment processors, delivery providers, IT service providers, professional advisers and public authorities where required for order fulfilment, legal compliance or the protection of legal rights.
11.4. Where identity verification is genuinely required for delivery or collection, only the minimum information necessary should be checked or recorded. We will not copy or retain identity document information unless this is necessary and lawful.
11.5. Information about the categories of personal data collected, purposes, lawful bases, recipients, international transfers, retention periods and individual rights is provided in our Privacy Policy.
11.6. You may have rights to access, correct, erase or restrict the use of your personal data, request data portability, object to certain processing and complain to a competent supervisory authority, subject to the conditions and exceptions established by applicable law.
12. COMMUNICATIONS
12.1. We will send order-related notices to the email address or telephone number supplied during checkout.
12.2. You may send notices, questions, cancellation requests and complaints to montekarlgroup@gmail.com or through the contact details published on the Website.
12.3. Electronic communications and information made available in a form that can be stored may constitute written information where permitted by law.
13. GOVERNING LAW AND DISPUTES
13.1. These Terms and contracts concluded under them are governed by the laws of the Republic of Lithuania.
13.2. If you are a consumer resident in the United Kingdom or another country, this choice of law does not deprive you of any mandatory consumer protections available under the law of your country of residence.
13.3. We encourage you to contact us first so that we can attempt to resolve any dispute amicably.
13.4. If a dispute cannot be resolved by negotiation, it may be submitted to a competent consumer dispute resolution body or court. Any mandatory rules concerning jurisdiction remain unaffected.
14. FINAL PROVISIONS
14.1. Product descriptions, prices, delivery information, returns information, these Terms and other contractual information published on the Website form part of the pre-contract information made available to you.
14.2. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
14.3. A delay in enforcing a right does not constitute a waiver of that right.
14.4. These Terms do not limit any statutory rights that cannot lawfully be excluded or restricted.
